VOLUNTEER WAIVER & RELEASE OF LIABILITY
This Volunteer Waiver and Release of Liability (this “Waiver”) is executed as of the date
listed below (the “Effective Date”) by the undersigned individual (the “Volunteer”) in favor of
Made to Serve, a Texas nonprofit corporation, and its directors, officers, employees, volunteers,
agents, and affiliates (collectively referred to as “Made to Serve”).
1. Volunteer Acknowledgment. The Volunteer understands that participation in the
activities, events, work, or projects of Made to Serve is voluntary, unpaid, and may involve risks,
including but not limited to personal injury, property damage, and illness. By signing this
Waiver, the Volunteer further understands and accepts these risks, assuming full responsibility
for any injury or loss resulting from participation, even if such injury or loss results from the
negligent or wrongful actions of Made to Serve.
2. Over the Age of 18. The Volunteer understands that participation in Made to
Serve is limited to individuals who are 18 years of age or older as of the Effective Date. By
signing this Waiver, the Volunteer affirms that he/she meet this age requirement.
3. Not an Employee. The Volunteer understands that he/she is not an employee of
Made to Serve nor did he/she obtain employment with Made to Serve by executing this Waiver.
The Volunteer further understands that participation in Made to Serve activities, events, work, or
projects shall not establish an employment relationship. The Volunteer understands that his/her
status as a volunteer may be terminated at any time, at the sole discretion of Made to Serve.
4. No Right to Receive Payment. The Volunteer understands that he/she have no
right to receive compensation, whether financial or otherwise, from Made to Serve as a result of
signing this Waiver or participating in Made to Serve activities, events, work, or projects.
5. Waiver and Release. The Volunteer, for themselves and his/her heirs, personal
representatives, and assigns, hereby voluntarily and irrevocably releases, waives, discharges, and
holds harmless Made to Serve from any and all claims, demands, causes of action, liabilities,
damages, or losses, whether known or unknown, arising out of or in connection with the
Volunteer’s participation in any Made to Serve activities, events, work, or projects , including but
not limited to, the preparation and distribution of meals to the homeless.
6. Medical Treatment. The Volunteer understands that Made to Serve assumes no
responsibility or obligation to provide financial assistance, medical care, or insurance in the
event of injury or illness. The Volunteer agrees he/she shall be solely responsible for any costs
related to medical expenses or other damages incurred as a result of participation in Made to
Serve activities, events, work, or projects. The Volunteer further understands that he/she is solely
responsible for assessing his/her physical and mental fitness to participate in Made to activities,
events, work, or projects. If the Volunteer requires medical attention, Made to Serve is
authorized, but not contractually required, to administer first aid and/or arrange for medical
assistance, transportation, or emergency medical services at the Volunteer’s expense. The
Volunteer further understands that Made to Serve does not provide volunteers health, medical,
disability, or any other insurance coverage. The Volunteer represents that, to the best of his/her
knowledge, he/she is in good health and suffer no physical impairment that would or should
prevent his/her involvement in Made to Serve activities, events, work, or projects.
7. Indemnification. The Volunteer agrees to indemnify and hold harmless Made to
Serve from any claims, lawsuits, or liabilities, including reasonable attorney’s fees and costs, that
may arise from any negligent, reckless, intentional or otherwise wrongful acts or omissions by
the Volunteer while participating in Made to Serve activities, events, work, or projects.
8. Photographic Release. The Volunteer understands that Made to Serve may take
photos or videos of the Volunteer. The Volunteer consents to use by Made to Serve of his/her
image, voice, and name in Made to Serve’s digital and print promotional, fundraising,
educational, and other communications. Made to Serve may use the materials without obtaining
the Volunteers approval or paying the Volunteer for such use. The Volunteer grants Made to
Serve all copyrights in, and waive any legal claims relating to, the materials, including those
relating to copyright, rights of publicity or privacy, or defamation, or arising from any distortion,
blurring, or alteration that may occur in the making, editing, or use of the materials.
9. Volunteer Conduct. The Volunteer agrees to adhere to the policies, procedures,
and guidelines set forth by Made to Serve and understands that failure to comply with such may
result in dismissal from participating in Made to Serve activities, events, work, or projects. The
Volunteer understands that Made to Serve does not tolerate bullying, harassment, threatening
behavior, or violence of any kind.
10. Governing Law. This Waiver shall be solely governed by and interpreted in
accordance with the laws of Texas, without regard to its conflict of law principles. Any dispute,
claim, or legal action shall be brought exclusively in the courts located in Travis County, Texas.
11. Severability. In the event that any provision of this Waiver is found to be invalid
or unenforceable, the remaining provisions shall remain in full force and effect.
By signing this Waiver, the Volunteer affirms that he/she has read this Waiver in its
entirety and fully understands its contents. The Volunteer understands that this Waiver is a
contract granting certain rights to and eliminates the liability of Made to Serve. The Volunteer
understands he/she is giving up certain legal rights and remedies that may have otherwise been
available to him/her.
